I've tried everything photoshop can save as.. am I missing something?
I just want to use a different icon and have it be transparent. I have the image in Photoshop and it's transparent but when I try to use it as an icon it loses transparency. GIF won't work either. Thanks

Use the free Icon Composer in Apple's dev tools to composite an image with an alpha channel or use Iconographer.

Ok I have the alpha channel, but it still won't read the transparency. What format should can I save it in????

Separate the image from the alpha channel. They must be separate to be of any use in either Icon Composer or Iconographer. Perhaps you should open an existing icon in one of these programs so you can see what I'm talking about.

Try using Pixadex. IIRC, I had the same problem while back, trying to put an icns icon onto my iPod. I think you load your icon into Pixadex, put it into the QuickDrop zone, then drag the folder whose icon you want to change onto there. For some reason, this works while copy/paste through Finder doesn't work - that sounds like what you've been trying.
